Legality of Fansubbed Anime
« on: January 01, 2005, 11:10:49 AM »
" The original creators or whoever holds the copyrights to the series, in a number of cases these aren't always the same people, owns all rights to the distrubtion and translation of their titles, and to be able to legally translate a series one must obtain a license to do so. Fansubberss do not have said license and under copyright laws are considered no different then an HK bootleg, both being unlicensed translations/distributions of said titles.

While most Japanese companies haven't really seemed to care much about fansubbers this has seemingly started to change. Recently AnimeSuki was contacted by Media Factory, Inc., a japanese studio, to remove torrents of its shows from the site because of this issue. Whether or not other anime studios will do the same is yet to be seen, but it just goes to show that if they want the original creators will and can enforce their copyrights against anyone who is distributing/translating their series without a license to do so. Legalize it!!! Legalize It!!!
fansubs is the best thing to happen to people around the world..
i didn't know you had to have a licsense for that..jeez...
i think that's what they did to fma...animesuki used to have downloadable episodes but they stopped because of the same license ordeal..

well synth while that is true most anime compnaies realize that with fansubbs it get the anime popular. and people want to buy it R1 dvd while media factory seem to the odd one out . I certainly am not paying $50 us to try out an anime series i have never seen . most anime companies see this and allow their work to be fansubbed . They should first deal with the HK dvd ripps than with fansubbers cuase at least no one earns money off of fansubs but the distrubuitors of HK dvd earn money off them and no royalties are paid to the anime creators. with fansubber u have at least more people want to buy the dvds. As for the .OGM and .MKV disturbutor of fansubs there a seperate problem

Hey I am a supporter of fansubs all the way, if just cause amercian subs & dubs are almost always utter crap.

Why on earth they don't get fansubbers to assist or give advice I don't know. They release inferior products, charge alot, then wonder why even hardcore anime fans don't buy.

I want my anime as intended by the original writers and artists thank you very much.

technically they are in legal loophole where they may sub series as long as media creator or R1 dvd anime companies don't mind .

"legal" is a very relative word.

Since everyone wants to be king, we don't have a "world" law on IP but a law as interpreted and implemented by each country's own system.

And Law is nothing without Enforcement.

fansubs are an abuse of that fact. Nothing more, nothing less.

If Japan/Korea/*insert anime producing country here* had the wherewithall to enforce their laws worldwide, fansubs would be illegal all over.

As is, people tend to drop it like it's hot when an anime is licensed in the us / for sat distribution / english dub / etc...as though only the US/Europe IP laws are to be respected. Silly really but who's complaining! So long as we get the eps!! lol

I'm not worried, either way, the good stuff will keep flowing.

All the IP laws and enforcement in the world haven't stopped software, mp3 and divx / xvid movie distribution and we all know how bitterly the BSA, RIA and MPIA are fighting to stop those.

Anime Forever!!!!

Worst come to Worst, we will just have to learn japanese and buy the original DVD / watch the TV feeds / divx encodes unsubbed. lol

The subbing of Naruto is not illegal, currently the rights to the show is not owned, and the makers of the show did not contact the different factions to have them stop what they are doing, until that happens it is still legal.  And plus if it was illegal Anbu would not continue the project.

Warone the rights ARE OWNED...by the original writers.

What you mean to say is right to PUBLISH for monetary gain.

Just because they didn't do it doesn't equate to acceptance or permission either.

It is and always will be illegal to sell fansubs unless permission is expressively given by copyright holder(s).

But all this is based in the fact we under US Copyright Laws.

What is wrong with our generation, why dont we read, all i said is that it is not illegal to sub naruto, since the studio that is currently doing the series has not contacted the different fansub groups to stop doing it, and how the hell did you reach selling fansub releases, I did not bring up that...
