Most of the anime around  cannot be sold. They're quasi illegal fansubs. Works not yet licensed in the USA and such but subtitled by fans of the japanese/korean anime industry.

They are available on the internet for free and you are welcome to them for free as well since they cannot legitimately be sold in the first place.

Every now and again you will come across some charlatan trying to sell these. You really shouldn't buy them because they are FREE.

If it's an original anime DVD bought from RUNES or so, then of course that is a different story and deserving of your money.

Nice try, but that is the same as selling cocaine, but only charging $10 for your time to source the 10 ball and wrap it up in a piece of foil.

The law will interpret this still as the sale of cocaine.

You'll be exonerated with that last scenario but not because you are slaving the drive. The fact that there was no sale of the product is key.

In the first scenario, you are still in the wrong as you are providing not only labour and media as you would like to believe but also an illegal copy of artwork for a price. The law will still interpret the sale of the disc with anime on it, as sale of anime.

No matter how you try to spin it. Exchanging currency for that illegal copy is wrong.

Keep in mind, that even distributing it without charging is still wrong but just less so as you aren't profiting financially from the act.

I think we all know it's wrong Kaizen, but it is a pretty easy sin to commit with a low risk of retribution.

The internet knows no boundaries. That copyrighted anime that cost a million dollars to produce in Japan suddenly finds itself for sale "free" in Trinidad. Now because Japan does not have an active anime theft agency in Trinidad, you'll be pretty safe from prosecution but be mindful, it is theft all the same.

btw, Microsoft does not sell nor support the XBOX system in Trinidad. So sale of even a console system falls into the grey area. As does modding same.

Don't even get me started on video clubs.

I just wanted to point out 1 thing. It's with regards to selling the cocaine i.e. packaging and reselling. Umm that's like ALL INDUSTRIES. I'll use the LARGEST eg that come instantly to mind: DELL. They REBRAND EVERYTHING and sell it to you. In fact think of all the brand named clothing that use CHILD LABOUR. It's ILLEGAL everywhere save where its being done and then even not that too, but you still buy their clothing don't you? Whilst we won't condone the re-distribution of free material at a premium you have to appreciate that if you wanted an entire anime series it's gonna cost you alot. ESPECIALLY if it's something like DBZ where you get a lousy 3-6eps for 19.95USD. Then take into account the series has over 100eps. You're SCREWED basically. So please don't PLUG RUNES when making your argument that was a bit obvious. I will say go legal if you can, but doh loud up a man for selling his services. The anime is FREE, the media is cheap the time, energy and effort are NOT. You're selling a service not the anime, Laruto is right by saying selling an illegal material is wrong, selling your services (not soliciting mind you) is not. (btw we not talking large scale here, we talking a man say AYE i want some anime could you get xyz for me?, SURE it'll cost yah 20$ a dvd though, cool scene). They're making a big hoora about selling copied stuff but my question is shouldn't you go after the ppl that buy illegal stuff as well? if thats the case that is, cause they are promoting pirating. Wait that sounds REMARKABLY LIKE THE RIAA... who btw recently served a subpeona to a family for pirating... funny thing is they doh even have a computer let alone internet access.. :p

oh come on larry,

there is terrible horrible wrong (like killing your mother)
and wrong (like killing a frog)

One will get you in jail for life

The other will get you a reprimand from your father.

In this case, selling anime illegally is the greater wrong.

Passing it along for free by sharing the source of the anime or such is the lesser wrong.

The key difference being the $$.

Poeple are particularly defensive when one starts making money off of their hard work.

While you can argue you're only charging for your time and the disk they would counter argue that those services would have had no value at all were it not for the illegal anime.

That is, the person would not have paid you $20 for your pengo cd and time if it did not contain Episode 1 - 10 of Record of Lodoss. lol

W1ntry, you are right on all counts unfortunately, that doesn't make it right to do wrong.

In a perfect world, all the video clubs should be closed and RIAA should arrest both the consumer of illegal media as well as the distributers.

Then again, in a perfect world, nobody would pirate another man's hard work.

once i hadda use my own discs, i WILL ask for money (unless is pardner).

there is NO profit involved in my case, i just ensuring that i don't end up with less money in my wallet after burning that dvd, everyone does do that at some point, isj ust only a few people like to admit it.

and murder cannot be compared to piracy, the piracy process in volves several parties all of which are equally guilty since iti s the SAME crime being committed.


I can understand that, no prifit is being made. Besides teh internet is a big free zone, and i'm sure that every one has some piece of pirated software or some other kind of material in their home. And while your all being so Self-righteous, why dont you investigate how, where and by whom your clothes are made by? I understand all the points that have been made, but if he's doing what he says hes doing (with out making a profit)  then its just a favor. If not then fine he's committing a crime (whos gonna stop him) and i'm preety sure he isn't ever gonna run out of customers, cuz why? We're all TRINI.

Unfortunately, once money is involved, the profit is not determined by you, it is determined by the law.

You could bet ADV will value their anime much moreso than your time and blank CD. So they will count the lions share of your $20.00 transaction as going towards the Anime.

Can't blame them either.

The safest bet is not to do it at all. No one is going to die if you don't burn a copy of Love Hina on a DVD for them.

They surely can't take you to jail for it either. No obligation.

If you still choose to commit the crime, then do so with that knowledge.

Just as video clubs continue to involve themselves in piracy to profit on a larger scale.

No one is arresting them (yet)

Lucky for us, the police are more concerned with blood crimes than cyber and copy right crime in Trinidad. Rightfully so. Just do not be deluded into thinking it is "right" to traffic stolen warez, regardless the source or nature.

The fact that most of us are guilty doesn't mean we should wallow in it.

Don't get me wrong, I'm not throwing the first stone here but keeping it real all the same.

Well as long as we're "keeping it real" you have to admit that it's not gonna change although i admire your spirit, as long as the internet exists thats the way the cookies gonna crumble  ^_^ in trinidad and the rest of the world even in countries where teh law is a little more enforced. Its what makes the world go around.

illegal or nor the companies producing these anime don"t really mind the fansubs

Fansubs expose the anime to the western viewers, increasing the chances that their product will be licenced by western distributors

That's a fallacy.

Japanese companies have called for the removal of fansub material from internet sites.

This may have had a sliver of truth to it 10 years ago but this is surely no longer the case.

Fansubs are illegal whether the series is licensed for distribution or not. This is because the copyright (which is completely unrelated to the right of distribution) applies even in countries where the series is not distributed in. See: the Berne Convention, specifically the parts about nationality of author, rights of translation and rights of reproduction. Here's a full list of signatories to the Convention. It is interesting to note that the mere act of making an unauthorized translation available for public usage is already illegal, much less the actual copyrighted footage.

To put it simply: fansubs helped to promote anime back when the word "anime" was not part of English and most animations on TV were Hana-Barbara, Disney and whatever else you Americans had. They were tolerated by Japanese companies for this purpose. Most studios also felt that it was not worth the effort to sue North American fansubbers, as they had, at that time, no assets in North America to protect. Suing could also potentially isolate their new fans and close up a potential market.

Today however, you ("you" being North Americans) can watch anime on cable TV, buy anime DVDs from any DVD stores, join an anime club in school and read about all the latest anime news on the internet. Fansubs today no longer play that single vital role in promoting a new series to foreign audiences. Yet because of their mass-availability through the internet, they are now hurting the sales of legitimate DVDs in North America, Asia and other regions. For this reason, Japanese companies have slowly started to take actions against fansubbers instead of waiting for a foreign distributor to do the job.
