Legality of Burnt games and CDs
«
on:
April 29, 2007, 12:48:20 AM »
Ok before this I cause mass confusion for the mods who uphold the rules i am not selling anything nor am i trying to condone burnt games/cds its just a question or 2. ( because i dont want to repeatedly say burnt games/cds all the time im giving it a short and easy to remember code name " ichigo "
)
Ok firstly i understand that most sites dont allow u to speak about ichigo due to the fact that it is considered illegal. But i seriously question the legality in trinidad as there are many stores that sell ichigo openly. Ive gotten reciepts after buying ichigo from some stores yes receipts! and besides that look at stores like nanans they openly sell ichigo have their own website and advertise in newspapers. Ive seen police at nanans many times and they actually buy ichigo too. Now what i want to know is, If this is how things are in trinidad how can ichigo be illegal is it that the websites are following americas laws rather than trinis laws or that Trinidad has the laws and just dont give a crap about it . So whether Trinidad has laws against it and dont bother with them or dont have strict copyright laws how can mentioning it on a website be anywhere near as bad as selling it openly in trinidad. And if it doesnt matter to trinidad law inforcement why should it matter to us as it doesnt affect us if we discuss and/or condone ichigo.
Note to Admins/mods : If i broke any rules by posting this i am sorry because i dont think i am breaking any rules by talking about it because talking about something illegal isnt illegal right? like if i said why is weed illegal theres nothing wrong with that. Anyway thats my logic

Nanan himself told that due to a loophole in the law regarding game console software (he would not tell me which law, and I never bothered to research it) he is able to continue doing business. Openly too. Everyone knows its piracy, but apparently he cannot be prosecuted.
The Business Software Alliance does not consider gaming software in its mandate, so all those 'ichigo' merchants can do their thing unchecked.

hhahaha @ ichigo. love it.
kudos for finding that thread on piracy disciple. It really dealt with the issue thoroughly.
As for gaming software not being a part of the BSA's remit. Hmm, I can see that line fast becoming blurred.
Microsoft is a massive contributor to the BSA and now they are a major player in the Gaming industry.
I'd say it is only a matter of time before ichigo comes under fire.
What has saved us thus far, is that the caribbean is not even considered a "region" by most gaming companies. As such, we aren't targeted.
There is no official release of XBOX or PS2 or Wii for the "caribbean". Nor would you ever see the stats for us being considered by them either. We just are swept under the rug at the moment.
Sooner or later, when it becomes easy or someone decides to focus on the little fish, we will find ourselves in a hot spot. Ichigo is rampant on the island, no doubt.
Personally, it is wrong from every stand point. Yes it is done and yes everyone is getting away with it (for now) but it is still wrong.
It also ultimately hurts the industry. The proliferation of ichigo that is.
From that standpoint, GATT never advocated ichigo. It remains a silent under current. The pink elephant in the room, so to speak. Everyone knows it is there, but no one talks about it openly on the forum.

ok thanx for responses but as u said the carribean isnt considered a "region" by gaming companies and until it is and they have official releases of consoles and games here we are going to be paying a hell of a lot for games. I personally wouldnt mind buying all my games original if we had them same price as the US. i find it a hassle to ship games so i resort to buying ichigo not only is it cheaper but its much easier to aquire than original games when i had my ps2 i went to a store to buy original games mentioned about 5 games i wanted they didnt have any.... i went to nanans they had all. So unless they make games cheaper or at least more available i think many people will resort to ichigo.

Well there is hope.
Direct Download.
If you got a PS3, you can buy Tekken 5: DR for a measly US$19.99 and download it directly to your console.
If every next gen console offers the same sort of service and convenience, you won't need to worry about ichigo anymore, so long as you have broad band or a friend with broadband.

The way i see it as more and more games go online like wow and xbox live the ichigo problem will surely vanish over time. I know there are hack servers and stuff but most are flaky and plagued by cheaters and what not. The cheap and legal way is to rent games, buy used ones and look for places that sell wow cards and live cards cheap

yes u can download tekken 5 dark resurection but it is an upgraded ps2 game not a ps3 game considering it an actual ps3 game would be like considering mortal kombat 2 a ps3 game rather than just an upgrade. But i have to admit classic MK fans would love MK 2 with online kombat its smart and at only $5 why not lol.

the ichigo seen is a bad thing but neccesary
but when u play games like wow and your copy is by your cousin in ny
it becomes very neccesary to get on to install so u can get value for your money
that is if Blizzard does not get sence and do like ncsoft and have the software as a free download on there site
