Miffed punter secures legal victory over DellWrit served where it won't be foundBy Nick Farrell: Thursday 11 January 2007, 09:00A DELL CUSTOMER who had a gutsful of Dell's customer service, managed to successfully sue the outfit for its shoddy service.Pat Dori spent five months and 19 phone calls trying to get Dell to fix a broken laptop. In the end he decided to sue the outfit for failing to adequately fix the problem.While this would normally force a person to expensive legal bills, Dori got around this by serving the court papers on a Dell kiosk. Generally these kiosks are staffed by part-timers who don't really care enough to forward any paperwork on.Sure enough, Dell didn't even know the papers had been served and was not in court on the day to defend itself.Dori managed to get a default judgement winning $3,000 and a ruling to allow bailiffs to close the kiosk and seize items if the judgement was not paid.Apparently Dell has now settled the case out of court for undisclosed terms. Dori told ithe New York Times that it seems that to get a problem fixed you have to get Dell's cash first which tends to attract its attention.He said that this is a much better way than shouting down the phone at Dell's customer support. µ
