Removal ofPresident fromoffice54.(1) Subject to subsection (2), the President shallvacate his office where the House of Representatives passes aresolution, supported by the votes of a majority of all themembers of the House, declaring that it has no confidence inthe President.(2) Where a resolution is passed under subsection(1), the President shall continue to hold office until a Presidentis elected and assumes office.(3) The succeeding President shall assume office inaccordance with section 49(4).
Immunities ofthe President57.(1) The President shall not be answerable to anycourt for the performance of the functions of his office or for anyact done by him in the performance of those functions.(2) Without the fiat of the Director of PublicProsecutions, no criminal proceedings shall be instituted orcontinued against the President in any court during his term ofoffice and no process for the President's arrest or imprisonmentshall be issued from any court or shall be executed during histerm of office.(3) No civil proceedings in which relief is claimedagainst the President shall be instituted during his term of officein any court in respect of any act done by him in his personalcapacity whether before or after he entered the office ofPresident, except on the condition specified in subsection (4).(4) The condition referred to in subsection (3) is thattwo months shall elapse after a notice in writing has beenserved on the President either by registered post or by beingleft at his office stating the nature of the proceedings, the causeof action, the name, description and address of the partyinstituting the proceedings and the relief claimed.(5) A period of limitation prescribed shall not run infavour of the President in respect of a civil action during theperiod of two months after a notice in respect of that action hasbeen served on him under subsection (4).
